Terms of Service

Last updated: October 26, 2026.

1. About these terms

These Terms of Service ("Terms") govern access to and use of cryptocurrency automated teller machines ("ATMs"), the website at https://bitcoinnearme.ca/ ("Website"), and related products and services (collectively, the "Services") operated by Bitcoin Near Me Inc., operating as Bitcoin Near Me ("BNMI," "we," "us," or "our").

By using the Services or confirming a transaction, you agree to these Terms. If you do not agree, do not use the Services or proceed with a transaction. Where a transaction screen asks you to confirm these Terms, you must do so before completing the transaction.

These Terms apply together with the disclosures and instructions presented during a transaction. If any provision conflicts with non-waivable rights under applicable law, the applicable law prevails to the extent of the conflict.

2. Eligibility and acting on your own behalf

You must be at least 18 years old, legally capable of entering into a binding agreement, and permitted by applicable law to use the Services. BNMI may request proof of age, identity, residence, source of funds, or other information to establish eligibility or comply with applicable obligations.

ATM transactions are available only to natural persons (individuals) acting on their own behalf. Transactions on behalf of a corporation or other entity, or any third party, are strictly prohibited. You may use the Services only for yourself, with funds and cryptocurrency that you lawfully own or are otherwise legally entitled to use. You must not act as an agent or nominee or arrange a purchase or sale for the benefit of another person or entity. BNMI may decline or stop any transaction that appears inconsistent with these requirements.

For cryptocurrency purchases, the destination must be either a self-hosted wallet that you own and control or an exchange-hosted wallet or account held and custodied in your own name, under your control as the account holder. Custody by an exchange for your own account is permitted. Sending cryptocurrency to another person’s or entity’s wallet or account, including an account held in someone else’s name, is strictly prohibited. When prompted, you must accurately confirm that the destination is your own wallet or exchange account and that you are acting on your own behalf. A false confirmation is a breach of these Terms.

3. Nature of the services

Available cryptocurrencies, transaction types, operating hours, locations, and features may vary and may change without advance notice, subject to applicable law.

FINTRAC registration is not yet confirmed. This website provides information and accepts enquiries; it does not process Bitcoin transactions.

Cryptocurrency transactions conducted through BNMI's ATMs are provided by Bitcoin Near Me Inc. (BNMI). BNMI may use third-party technology and service providers to facilitate these transactions. BNMI is not a bank, deposit-taking institution, investment adviser, payment processor, fiduciary, or custodian of your personal cryptocurrency wallet. BNMI does not provide investment, legal, or tax advice and does not guarantee that any cryptocurrency is suitable for you.

4. Customer instructions and wallet responsibility

Before confirming a transaction, you must carefully verify the transaction amount, asset, destination wallet address, blockchain network, quoted exchange rate, and any applicable fees. It is your responsibility to ensure that your wallet supports the cryptocurrency and network selected and that you can access and control the wallet.

You authorize BNMI to process the transaction according to the details you confirm. You acknowledge that blockchain addresses, QR codes, and transaction instructions may be difficult or impossible to correct once a transaction is broadcast. BNMI is not responsible for losses caused by incorrect or incompatible wallet information, customer-input errors, failure to maintain wallet access, or other incorrect instructions provided or confirmed by you, where BNMI has properly executed your authorized instructions and to the extent permitted by law.

You are responsible for keeping private keys, recovery phrases, passwords, and wallet credentials secure. BNMI will not ask you to disclose your wallet recovery phrase to complete an ordinary ATM transaction.

5. Quoted exchange rates, spreads, and fees

BNMI determines the exchange rates it offers for cryptocurrency transactions. BNMI's quoted rates may differ from prices displayed by trading platforms, market-data services, or other ATM operators. The quoted rate incorporates BNMI's commercial spread or markup and may reflect operating costs, expected blockchain network costs, and market conditions.

Any separate transaction fee will be disclosed on the applicable transaction screen. The amount of any fee and the applicable quoted rate will be disclosed before the customer confirms the transaction. BNMI does not promise that a particular rate, spread, or fee will remain available for future transactions.

Unless an additional network fee or other charge is expressly disclosed before confirmation, BNMI does not separately charge the customer a blockchain network fee. Any costs BNMI incurs to transmit cryptocurrency may be reflected in its quoted rate.

The customer agrees to the quoted rate, disclosed fees, and resulting cryptocurrency or cash amount by confirming the transaction. BNMI has no obligation to match another provider's rate or reimburse differences between its quoted rate and a third-party market price.

6. Transaction processing and blockchain confirmation

Following successful processing of a supported cryptocurrency purchase and completion of required checks, the cryptocurrency transaction is submitted to the applicable blockchain network. No immediate-broadcast timing is promised. Processing and broadcasting may be delayed by identity verification, compliance review, security controls, system or provider availability, transaction screening, or other operational conditions.

A transaction broadcast to a blockchain is not the same as a transaction confirmed or finalized by that network. Confirmation and final settlement depend on the applicable blockchain protocol, network congestion, miner or validator activity, network fees, and other circumstances outside BNMI's control. BNMI does not guarantee a particular confirmation time or the time at which a wallet provider will display or make cryptocurrency available.

BNMI may delay, decline, suspend, or refuse processing when required or permitted by applicable law, its compliance procedures, security concerns, or technical limitations. BNMI may be prohibited by law from explaining certain compliance-related decisions.

7. Finality customer error scams

Completed cryptocurrency transactions properly executed by BNMI according to the customer’s confirmed and authorized instructions are final and non-refundable, except where a refund or other remedy is required by applicable law. Once broadcast, blockchain transactions cannot be reversed by BNMI. Cash insertion alone does not mean that a cryptocurrency transaction has been executed or broadcast.

BNMI is not responsible, to the extent permitted by applicable law, for losses arising from a customer's mistaken address or network selection, dealings with a scammer, reliance on false or misleading representations by another person, a decision to transact under pressure from a third party, loss of wallet access, market movements, or a change of mind, where BNMI has properly followed the customer's authorized instructions and satisfied applicable legal obligations.

No statement in these Terms requires a customer to waive rights or remedies that cannot lawfully be waived. If a transaction is uncompleted, BNMI will complete it where possible or refund the customer if BNMI is unable to complete it, subject to applicable law, including any lawful restriction on releasing funds. This does not create a right to cancel or obtain a refund for a completed transaction.

8. Fraud prevention and customer acknowledgments

Cryptocurrency is frequently used in scams, including government or police impersonation, fake tax demands, romance scams, fraudulent investments, fake technical support, employment scams, and requests to pay alleged debts, fines, or fees in cryptocurrency. A legitimate request from another person is not established merely because that person provides a wallet address, QR code, identification, or apparently official documents.

Do not use an ATM if another person is instructing you to send cryptocurrency to them, controlling your transaction, pressuring you to act urgently, or telling you to hide the transaction from BNMI, family members, your bank, or authorities. Do not proceed if you do not independently understand and approve the transaction.

When required by the ATM interface, you must truthfully acknowledge that you are acting on your own behalf, control the receiving wallet, and are not making a transaction for another person's benefit. BNMI may refuse transactions where these representations are absent, inaccurate, or appear inconsistent with other information.

For additional safety information, see our Customer Safety page (https://bitcoinnearme.ca/safety/).

9. Verification, records, and regulatory compliance

BNMI may collect, verify, record, and retain information about you and your transactions as required or permitted under applicable anti-money-laundering, anti-terrorist-financing, sanctions, fraud-prevention, tax, and other laws and risk-management procedures. This may include personal identification, transaction details, source-of-funds information, wallet information, and information concerning the originator or beneficiary of transfers when applicable.

BNMI may request additional documents, apply operational or risk-based limits, conduct checks, or delay or refuse a transaction. Purchases without full KYC are limited to CAD $995 per mobile telephone number per calendar day, based on Eastern Time, across BNMI ATMs. Cash payouts for cryptocurrency sales to BNMI are limited to CAD $800 per customer per calendar day, based on Eastern Time, across all BNMI ATMs and supported cryptocurrencies combined. Multiple transactions share the applicable daily limit. Additional restrictions may apply. These limits do not guarantee that any transaction is exempt from identity verification or other applicable requirements.

Subject to applicable law, BNMI reserves the right to decline to provide Services to any person, or to restrict or discontinue access to the Services, for any reason and without providing a reason. This does not remove BNMI’s obligations concerning funds already accepted for an uncompleted transaction.

You agree to provide accurate and current information and not to evade identity verification, service limits or other applicable requirements. Splitting transactions or using different telephone numbers, identities, wallets or ATMs to circumvent these requirements is prohibited. BNMI may make disclosures where required or permitted by law.

10. Prohibited activity

You must not use the Services in connection with unlawful conduct, fraud, scams, money laundering, terrorist financing, sanctions evasion, trafficking, ransomware, stolen funds, unauthorized access, or other prohibited activity. You represent that funds and cryptocurrency used in a transaction are derived from lawful sources and that the transaction is lawful.

You must not provide false information, impersonate anyone, use another person's identity without authorization, attempt to circumvent transaction controls, interfere with an ATM or the Website, exploit technical errors, or assist another person in violating these Terms.

BNMI may deny access, cancel a transaction before execution, preserve relevant records, or take other legally permitted measures in response to suspected violations.

11. Risks of cryptocurrency

Cryptocurrency prices may change rapidly and substantially. Transactions may incur blockchain confirmation delays, forks, network disruptions, software errors, wallet incompatibilities, or loss of access. Cryptocurrency may not be protected by deposit insurance or other protections applicable to traditional bank deposits. You are responsible for independently evaluating whether a transaction is appropriate for you.

Information published by BNMI is provided for general information and is not a recommendation to purchase, sell, or hold any cryptocurrency. BNMI does not guarantee cryptocurrency value, future market performance, acceptance by third parties, or uninterrupted network availability.

12. Service availability and third-party systems

BNMI may maintain, upgrade, modify, interrupt, limit, or discontinue the Services, temporarily or permanently, for operational, security, compliance, commercial, or technical reasons, subject to applicable law. ATMs and the Website may occasionally be unavailable or inaccurate due to communications issues, hardware faults, third-party services, or other causes.

BNMI relies on blockchain networks, telecommunications providers, software providers, and other third-party systems that BNMI does not control. BNMI does not guarantee uninterrupted access or error-free operation. Nothing in this section limits rights that cannot lawfully be excluded.

13. Website use

You must not disrupt or compromise BNMI's Website, ATMs, software, or systems; attempt unauthorized access; introduce malicious code; perform automated scraping or abusive traffic; or circumvent applicable technical or security controls. Restrictions on reverse engineering apply only to the extent permitted by applicable law.

14. Privacy

BNMI's collection, use, disclosure, retention, and protection of personal information are described in its Privacy Policy, available on our Privacy Policy page (https://bitcoinnearme.ca/privacy/). The Privacy Policy explains how personal information may be handled in connection with Website enquiries, ATM transactions, identity verification, legal compliance, security, and related business operations.

By using the Services, you acknowledge that BNMI processes relevant personal information as described in its Privacy Policy and as otherwise permitted or required by law. Where consent is legally required, BNMI will seek it as applicable. These Terms do not replace the Privacy Policy or any rights conferred by privacy law.

15. Limitation of liability

To the fullest extent permitted by law, BNMI and its directors, officers, employees, contractors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, or market-value changes, arising out of the Services, even if advised of the possibility of such loss.

To the fullest extent permitted by law, BNMI is not liable for loss arising from customer-provided or customer-confirmed instructions properly carried out by BNMI; unauthorized or fraudulent conduct by third parties; customer wallet or credential compromise; or blockchain confirmation delays and failures beyond BNMI's reasonable control, provided BNMI has complied with its applicable legal obligations.

For claims that may lawfully be limited, BNMI's aggregate monetary liability arising from a particular transaction shall not exceed the total cash amount paid by the customer for that transaction or the amount of cryptocurrency delivered by the customer to BNMI for that transaction, valued in Canadian dollars at the agreed transaction rate, as applicable. This cap does not create a right to recover the full transaction value where no such right otherwise exists. It does not limit liability that cannot lawfully be limited, including any non-excludable statutory remedy.

No provision of these Terms excludes liability for BNMI's fraud, wilful misconduct, or any other liability that cannot be excluded under applicable law.

16. Indemnification

To the extent permitted by law, you agree to indemnify BNMI against reasonable third-party claims, losses, and expenses directly arising from your unlawful use of the Services, material misrepresentations, or intentional violation of these Terms, except to the extent caused by BNMI's own wrongdoing or where such indemnity is prohibited by applicable law. This clause does not require you to indemnify BNMI for a claim arising solely from BNMI's failure to perform its own obligations.

17. Changes to these terms

BNMI may revise these Terms as its Services, practices, or legal obligations change. The current version and effective date will be posted on the Website or otherwise made available as required by applicable law. A transaction is generally governed by the version presented or applicable at the time that transaction is confirmed, subject to applicable law. BNMI will provide any notice or obtain any consent required by law for material changes.

18. Governing law and disputes

Except where mandatory law provides otherwise, these Terms are governed by the laws of Ontario and applicable federal laws of Canada. Subject to any non-waivable consumer rights or statutory rights to bring proceedings elsewhere, courts located in Ontario have jurisdiction over disputes arising from these Terms.

Before commencing formal proceedings, you may contact BNMI using the contact details below to describe a concern and give BNMI an opportunity to review it. This does not require you to surrender legal rights or miss a statutory deadline.

19. General provisions

If a provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. BNMI's failure to enforce a provision on one occasion is not a waiver of its right to enforce it later. Headings are for convenience only. No person other than BNMI and the customer is intended to receive contractual rights under these Terms, except where expressly provided or required by law.

These Terms, together with transaction-specific disclosures accepted by the customer and any expressly applicable additional terms, form the agreement governing the applicable Services. Nothing in these Terms removes rights that customers cannot waive under applicable law.
